Realising the Final Charging Orders That You Have
In our experience, companies who have obtained Final Charging Order's on their debtor's property have not known how to recover that security. It is common practice to sit on a Charge awaiting a sale or re-mortgage, running the risk that the debtor (who is in financial difficulty) will continue to make their mortgage payments.
How do you unlock the potential and recover monies? We can help! We provide reports which evaluate the debtor's current financial position, together with assessing the validity of whether there is equity in the property to realise your Charge. We can then undertake the recovery of that secured debt. For details about these services, please contact Gareth Rhodes on 0113 3200264 or alternatively, email him on gr@tremark.co.uk.
What is Debt Recovery?
The perception of a Debt Collector is often a bulky shaven-haired man wearing a doorman's coat, a cricket bat in one hand and the debtor by his ankles in the other, usually shaking money out of their pockets. Although we want to keep such an image; like all professionals, Debt Recovery is more that than. More often than not, we are negotiators; if a debtor owes you, they owe others and so tipping them over the financial edge isn't beneficial to anybody.
The advantage is knowledge. Knowing your debtor both financially and circumstantially opens negotiations and stops dispute or stalling tactics.
For example; a debtor recently stated that their business was struggling and that they were only in a position to offer £50 per month. From the information we had gathered, the perspective was very different. We knew that the debtor had owned their property for some time, with only the original mortgage; suggesting that there was equity. We also knew that their business was doing well and the debtor was a 'won't payer', unwilling to raise funds to pay their debt. With this information, we were able to have the debt paid.
Recession or no recession, people who want to avoid their liabilities, plead hardship; but when this is the case, you, through us, are in control. Perhaps it is a case of getting the debtor by their ankles and allowing the information and then the money to fall out of their pockets.
HMRC Debt Help Hiding Corporate Insolvencies, Claims Expert
The help in deferring tax payments given to businesses by HM Revenue and Customs (HMRC) could actually be hiding the true extent of corporate insolvencies, according MCR Tax Arrears Solutions.
Steve Clancy, Partner at MCR points out that HMRC is now "acting more like a lender than a tax collector", and is likely to start calling in its debts. This could mean a sharp increase in the level of company insolvencies.

Why TREMARK Trace?g>
Traces are carried out for various reasons:-

To locate somebodys' whereabouts who is in debt,
To assist in finding beneficiaries,
To locate friends or relatives.

What is a Trace?

A trace is carried out on an individual where contact has been lost or an individual no longer resides at their last known address. These individuals are known as 'gone aways' or 'absconders'.

How is a Trace Conducted?

TREMARK use specially trained agents who will use various sources such as client information, public databases and credit reference agencies to try and ascertain a new address.

When TREMARK are instructed, we usually have at least a name and a last known address to work from. Our specialist trace team will begin enquiries to ascertain a date of birth and any other information.

Once we have traced an individual, we will confirm they are resident at the address, complying with the Data Protection Act.

Verification can be conducted by making telephone contact, sending a letter and/or making a field visit.

Trace Facts:-

In 2009, it is estimated that up to 70% of all instructions to collect debt will required a trace.

In 2009, nine million trace investigations were carried out by specialist trace agents.

OFT To Consult on Debt Collection

The Office of Fair Trading (OTF) is due to launch a consultation on draft guidance for debt collection. The OFT expects to consult for 12 weeks before publishing final guidance in the autumn.
